Barry Kane

Barry Kane is the managing member and founder of the firm. Mr. Kane is a registered patent attorney counseling corporations and individuals on a wide range of intellectual property matters. Prior to starting Kane & Company, Mr. Kane was a member and the chair of the Intellectual Property Department in a law firm of 100+ attorneys located in Grand Rapids. Before entering private practice in 1991, Mr. Kane was with the corporate legal department of Western Atlas International, Inc. in Houston, Texas, a joint venture of Litton Industries and Dresser Industries.


Patent and Intellectual Property Counsel

Mr. Kane possesses extensive experience counseling on a broad spectrum of intellectual property issues, including patent, trade secret, trademark, and copyright and unfair competition matters. During his career he has dealt with diverse patent matters including patent availability opinions, patent preparation, patent reissues and re-examinations, patent infringement and defense litigation, and patent interference proceedings. With respect to the field of trademarks, Mr. Kane has advised clients on the availability, adoption and use of trademarks and service marks, federal and state registration for such marks, unfair competition claims including actions for false advertising as well as “knock off” products, and related litigation. In the area of technology and e-commerce, Mr. Kane has reviewed and prepared a substantial number of computer software development and licensing agreements, purchase contracts and addressed a variety of Internet business issues, including click-license agreements and domain name disputes. He also has experience advising clients on copyright issues and represents musicians and performers in matters involving recording contracts, agent and publishing agreements, and literature ownership claims. Mr. Kane also has substantial experience in conducting intellectual property audits for companies seeking to generate revenue streams from unused technology.

Mr. Kane is admitted to practice in California, Florida, Indiana, Michigan, and New York, and before the United States Patent and Trademark Office. He is also admitted before several appeals courts, including the United States Supreme Court, the Court of Appeals for the Federal Circuit, the Court of Appeals for the Sixth Circuit, and the United States Districts Courts for the Northern and Central District of California, Connecticut District Court, the Central District of Florida, the Eastern and Western Districts of Michigan, the Southern District of New York, and the Central District of Texas, among others.

Mr. Kane is also a member of the American Intellectual Property Law Association, where he has served as Assistant Chair for the Unfair Competition Subcommittee. He is also a member of the Intellectual Property Section of the American Bar Association, the State Bar of Michigan, and the Grand Rapids Bar Association.

Articles and Presentations

Mr. Kane was a regular contributor to Business Alert and Business Law Update publications, and has lectured and written on intellectual property topics for professional journals and meetings, including patents, trademarks, Internet domain name disputes, copyrights and e-commerce. From 1992 through 1997, he was the co-author and editor of the Michigan Chapter for the International Trademark Association publication entitled, Trademark, and Unfair Competition.


Mr. Kane received his law degree from Texas A & M University South Texas College of Law where he was a member of the Law Review and served on the Law Review Board. He received his Master of Science degree in Geophysics from theUniversity of Florida and his undergraduate degree in Geology from the University of Northern Colorado.
